1) Acceptance and changes

By accessing or using Unova Digital, you represent that you have read and agree to these Terms. We may update this document at any time to reflect legal, technical or business changes. The current version will be published with an updated effective date. Continued use after changes implies acceptance.

2) Eligibility and registration

You must have legal capacity to enter into contracts. To use restricted features, you may need to create an account, providing true and up-to-date information. You are responsible for keeping your credentials confidential and for activities carried out under your account.

3) Services and availability

Unova provides tools for managing personal data, including control of monitored data, DSARs, consent management, reports and integrations. We may add, change or discontinue features (including beta features) at any time, with reasonable notice where appropriate.

4) Licence to use and restrictions

We grant you a limited, non-exclusive, non-transferable and revocable licence to access and use the services in accordance with these Terms and applicable law.

You must not: (i) bypass technical measures; (ii) carry out reverse engineering, except to the extent permitted by law; (iii) commercially exploit the service without authorisation; (iv) use the service for unlawful purposes, infringing third-party rights or the LGPD/GDPR; (v) overload the infrastructure through abusive automation.

5) Conduct and prohibited uses

  • Publishing illegal, offensive, defamatory content or content that infringes third-party rights;
  • Attempting unauthorised access to accounts, systems or data;
  • Distributing malware, phishing or fraudulent activities;
  • Using personal data without a legal basis or in disagreement with lawful purposes.

6) User content

You retain the rights over the content you submit, declaring that you have the necessary authorisations. By submitting content, you grant Unova a licence to host, process and display this content to the extent necessary for service provision and legal compliance.

7) Intellectual property

All rights over the platform, trademarks, code, layouts and materials belong to Unova Digital or its licensors. No rights are transferred beyond the limited licence to use set out in these Terms.

8) Privacy and cookies

The processing of personal data follows our Privacy Policy and our Cookie Policy. By using the platform, you acknowledge and agree to these documents.

9) Plans, payments and trials

Plans, prices, billing cycles and conditions for free trials (where offered) are described at the time of subscription. Charges, taxes and refund policies follow the terms displayed at purchase and, where applicable, specific contracts.

10) Support and SLA

We provide support via our official channels. Specific SLAs may be described in business plans or dedicated contracts. Unless otherwise stated, the services are provided “as is”.

11) Warranty disclaimers

To the fullest extent permitted by law, Unova does not warrant that the services will be uninterrupted, error-free or free from vulnerabilities. We do not accept responsibility for decisions taken based on system reports or data without additional validation by the user.

12) Limitation of liability

To the extent permitted by law, Unova’s total liability for any damages arising from these Terms or from the use of the services is limited to the amount actually paid by the user in the 12 (twelve) months preceding the event. In no event shall we be liable for indirect damages, loss of profit, loss of data or consequential damages.

13) Indemnity

You agree to indemnify and hold Unova harmless from claims, losses and expenses (including legal fees) arising from misuse of the services, breach of these Terms or infringement of third-party rights.

14) Suspension and termination

We may suspend or terminate access if we identify a breach of these Terms, security risk, court order or legal non-compliance. You may close your account at any time; certain obligations and rights will survive (for example, intellectual property, limitations of liability and dispute provisions).

15) Third-party services

Third-party integrations and links are subject to their own terms. Unova is not responsible for the content, policies or practices of such third parties. Always read and accept the applicable terms and policies before use.

16) Security and reporting

We adopt technical and organisational measures appropriate to the risk. If you identify vulnerabilities or incidents, please report them immediately to en.security@unova.digital. We will cooperate in good faith for mitigation and, where applicable, legally required notifications.

17) Governing law and jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil. The courts of São Paulo/SP are chosen as the competent jurisdiction, with waiver of any other, however privileged it may be, except where otherwise required by law.

18) General provisions

  • Electronic communications: you agree to receive notices by electronic means.
  • Assignment: you may not assign rights/obligations without prior consent; we may assign them in the context of corporate restructuring.
  • Severability: if any provision is held invalid, the remaining provisions shall remain in force.
  • No waiver: failure to enforce any provision does not constitute a waiver of rights.
  • Entire agreement: these Terms constitute the entire agreement between the parties regarding their subject matter.
  • Language: in the event of versions in other languages, the Portuguese version shall prevail.
